NOTICE OF FINDING OF NO SIGNIFICANT IMPACT AND
NOTICE OF INTENT TO REQUEST A RELEASE OF FUNDS

This Notice shall satisfy the above-cited two separate but related notification requirements for activities to be undertaken by the Redevelopment Authority of the County of Lancaster (Authority).

 REQUEST FOR RELEASE OF FUNDS

On or about June 30, 2013, the County of Lancaster (County) will submit a request to the U.S. Department of Housing and Urban Development (HUD) for the release of Community Development Block Grant (CDBG) funds under Title I of the Housing and Community Development Act of 1974, as amended, to undertake the following project:

Project Title: Mt. Hope Retirement Community Sewer Project

Purpose: Construction of a new package sewage treatment facility (WWTF) and associated sewer conveyance system to serve all of the existing facilities on the campus of Mt. Hope Nazarene Retirement Community.  The new WWTF will have capacity to serve the construction of future affordable housing.

Location: 3026 Mount Hope Home Road, Rapho Township, Lancaster County. Pennsylvania

Estimated Cost: $250,000 of CDBG funds with a total project cost of $875,906.00.

 FINDING OF NO SIGNIFICANT IMPACT

The County of Lancaster has determined that the above referenced projects will have no significant impact on the human environment.  Therefore, an Environmental Impact Statements under the National Environmental Policy Act of 1969 (NEPA) is not required.  Additional project information is contained in the Environmental Review Records (ERR) on file at the Authority office, 202 North Prince Street, Suite 400, Lancaster, Pennsylvania, and may be examined or copied weekdays from 8:30 a.m. to 4:00 p.m.

PUBLIC COMMENTS ON THE FINDING

Any individual, group, or agency disagreeing with this determination or wishing to comment on the above project may submit written comments to the Authority.  All comments received by June 27, 2014 will be considered by the County prior to authorizing submission of a request for release of funds.  Commenters should specify which part of this Notice they are addressing.

RELEASE OF FUNDS

The County certifies to HUD that Matthew Sternberg in his capacity as the Executive Director of the Authority consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process, and that these responsibilities have been satisfied.  HUD approval of the certification satisfies its responsibilities under NEPA and related laws and authorities, and allows the County to use program funds.

OBJECTIONS TO RELEASE OF FUNDS

 HUD will consider objections to its release of funds and the County certification received by June 27, 2014 or a period of fifteen days from its receipt of the request (whichever is later ) only if they are on one of the following bases: (a) the certification was not executed by the Certifying Officer or other officer of the County approved by HUD; (b) the County has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR Part 58; (c) the grant recipient or other participants in the development process have committed funds,  incurred costs or undertaken activities not authorized by 24 CFR Part 58 before approval of a release of funds by HUD/State;  or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality.

Objections must be prepared and submitted in accordance with the required procedures (24CFR Part 58) and shall be addressed to HUD, Office of Community Planning and Development, at the Wanamaker Building, 100 Penn Square East, Philadelphia, PA 19107-3380.  Potential objectors should contact HUD to verify the actual last day of the objection period.
